La Línea deposit rules

Under Spanish rental law (Ley de Arrendamientos Urbanos), landlords can ask for up to two months' rent as a security deposit for unfurnished properties. This must be deposited with the Junta de Andalucía and returned at the end of your tenancy, minus any deductions for damage.

Since 2019, agency fees must be paid by the landlord in Spain, not the tenant. If an agent tries to charge you, you can legally refuse. The calculator includes a toggle for this in case you encounter it.

Most tenants moving into La Línea need 3–4 months' rent available upfront when you factor in deposit, first month, and any miscellaneous costs.

Frequently Asked Questions

How many months deposit is standard in La Línea? +
In Spain (and La Línea), the standard security deposit is two months' rent for unfurnished properties and one month for furnished, as set by the Ley de Arrendamientos Urbanos (LAU). In practice, two months is the norm for most rentals in La Línea. Some landlords may ask for an additional guarantee (aval bancario) for foreign tenants.
Is the deposit protected? +
In Spain, landlords are legally required to deposit the security deposit with the regional housing authority (Junta de Andalucía, in La Línea's case). This offers tenants some protection. Make sure your landlord confirms this has been done at the start of your tenancy.
Do I need to pay agency fees in Spain? +
Since the 2019 housing law reform, in Spain agency fees for residential rentals must be paid by the landlord, not the tenant. However, in practice some agents still try to charge tenants. You are legally entitled to refuse. If you are finding a property through a private landlord directly, there are no agency fees.
